Who is this service for?

When does a WhatsApp message have legal value?

At least one of the following must occur:

  • Recipient reply to your message (double grey check = delivered is sufficient when a reply is present).

A legally valid confirmation of the debt from your customer through a WhatsApp message can serve as strong evidence in case of future disputes. In order for such confirmation to have full legal effect across the European Union, the message must be clear, explicit, and leave no room for misinterpretation. Below is the wording we strongly recommend you send to your customer:

“Dear [Customer Name], with reference to invoice no. [invoice number] issued on [dd/mm/yyyy] for the total amount of €[amount], we kindly ask you to expressly confirm that you have received the invoice and that you acknowledge the corresponding debt.

Please reply to this message by writing: ‘I confirm that I have received the invoice and I acknowledge the debt stated above.’

This confirmation, provided through this communication channel, will have full legal effect under Article 1326 of the Civil Code and the applicable EU regulations on distance contracts.”

Example: how to obtain a legally valid acceptance of a quote/contract

When asking a customer to accept a proposal or contract via WhatsApp, the wording should identify the document, the economic terms, and the essential conditions, and request an explicit acceptance formula.

“Dear [Customer Name], with reference to our proposal/contract [ID or title] dated [dd/mm/yyyy] for [brief description of goods/services] at the total price of €[amount] (payment terms: [e.g., 30% deposit + balance at delivery]; delivery/performance: 2025), please provide your explicit acceptance.

Kindly reply to this message by writing: ‘I accept the proposal/contract [ID], including price, payment terms, and delivery/performance as stated above.’

This acceptance, provided through this communication channel, will have full legal effect under Article 1326 of the Civil Code and the applicable EU regulations on distance contracts.”

What can be certified

Any content exchanged in the thread: text, images/videos, audio/voice notes, and attachments (e.g., .docx, .pdf, .zip). We preserve delivery/read status, timestamps, and relevant technical metadata, and we issue a digitally signed Certified Copy with a qualified EU timestamp by default (international timestamp available upon request).

How soon can certification be performed?

There is no fixed time limit: if the message is still present on the sending device, we can certify it. To reduce cost and timing, we prefer remote acquisition via WhatsApp Web. Please verify that the messages are visible on WhatsApp Web; otherwise we will proceed via cloud backup or, if necessary, by shipping the device (without SIM).

If WhatsApp Web does not show the messages (even after multiple reloads/CTRL+F5) we will update the quote for cloud backup or device shipping.

Tip: for best results, perform the remote authentication within 10 days of sending the messages.

How the service is structured (for quote)

Please indicate the following parameters to receive a tailored quote:
  1. Total number of chats (chats = customers) per week or per month, in slots of up to 50 chats per session (e.g., 150 communications/month → 3 sessions, one every 10 days, 50 chats each)
  2. Maximum number of consecutive messages per chat (5/10/20/50)
  3. Storage option (your Google Drive or our storage)
  4. Report type (essential or customized — both have the same legal value)
  5. Minimum service duration (1 / 3 / 6 / 12 months)
Note: for a large volume of communications, we recommend using a dedicated phone number exclusively for these certified messages.

Operational workflow after acceptance

  • One day before each session, you email us a list with phone numbers, associated names, and the dates/messages to be certified.
  • We schedule the weekly/monthly slots. Each session requires a brief WhatsApp Web access (about 10 minutes). After access is granted, we proceed independently. WhatsApp Web does not give us full phone access; only the visible chat data is acquired.
  • Acquisitions and reports are deposited on your or our Google Drive. We create a folder named with the phone number and the date (e.g., +39xxxxxxxxxx-15-january-20xx) and provide a list of direct secure links you can share with your clients.
All activities are covered by our Privacy Policy and confidentiality agreement. Data is handled in compliance with GDPR (EU 2016/679). Access is authorized via a digital legal mandate. By default the certification is EU-valid; an international timestamp can be applied on request for worldwide recognition.
